- Preliminary Remarks
IBH is a nonprofit association which specializes in language training and further academic education as well as in professional and pre-university qualification, and in the cultural education of immigrants and foreigners who wish to study and work in Germany.
The following General Business Terms concern different educational services (language courses, exams, summer courses, and the like) offered by IBH and subject to charges, which constitute a direct contractual relationship between the participant and IBH.
As far as professional training and other courses are concerned which IBH runs on behalf of federal and state authorities (e.g. integration courses, profession-related German language courses, coaching for participants who have completed the profession-related German courses), public institutions such as colleges and universities or private institutions (e.g. foundations, business firms), the contractual provisions between IBH and the respective customer apply.
- General Prerequisite of Participation
The courses offered by IBH are in principle designed for adults. Adolescents under 18 years of age may also participate with the agreement of their parental or legal guardians.
Enrollment takes place either by filling out a contract in writing or by completing an online form.
Any written enrollment including enrollment by online is binding and requires the full payment of the course booked, unless the applicant declares in writing his/her withdrawal from what he/she has booked within the period of cancellation. Enrollment will not be confirmed until the full amount or at least 50 per cent of the course fee has been paid, or a third party agrees to pay the cost (the employer or the institution which grants a scholarship, e.g.). Upon enrollment the participant agrees that IBH processes his/her personal data for internal use. This use comprises in particular registration and settlement of accounts, the issue of certificates to be presented to authorities, the delivery of teaching materials and information regarding course organization as well as certification of achievements.
- Withdrawal / Cancellation
Withdrawal from the enrollment contract must be made in writing. Withdrawal is possible up to two weeks prior to the beginning of the course, withdrawal from an accommodation booking is possible up to four weeks prior. In order to become effective, the cancellation must arrive at IBH within the period stipulated.
Withdrawal at a later date is not possible. If a participant cancels a course for which IBH has issued him/her a certificate of enrollment in order to apply for a permit of residence, a notice of rejection by the embassy must be presented.
If cancellation takes place correctly and in time, the full course fee will be refunded. IBH reserves the right to charge an administrative fee.
- Participant is unable to attend
If a participant is, for personal reasons (e.g. illness, problems of residence, personal obligations) unable to attend classes after the course has begun, he/she is not entitled to a refund or to take a different course at a later date.
- Cancellation of a Course by IBH
IBH may cancel a course up to two weeks prior to beginning. In this case, the full amount of the fee will be refunded.
- Insurance and Liability
The course fee does in principle not include any insurance protection. It is up to the participant to care for his/her own health, accident and liability insurance. He/she is liable for any damage he/she causes culpably, especially in rooms and residences rented through IBH.
- General Provisions
Invalidity and impracticality of individual provisions of the General Business Terms do not affect the validity of the remaining provisions.
Place of fulfillment and jurisdiction for the contracting parties is Hamburg
